TERMS OF SERVICE

Welcome to Sunshine Snap Photo Booth. By booking, using, or accessing our services through our website (www.sunshinesnapphotobooth.com), you agree to these Terms of Service. These terms govern all photo booth services provided by Sunshine Snap Photo Booth LLC (“Provider,” “Company,” “we,” or “us”). Please read them carefully. By hiring Sunshine Snap Photo Booth for any event, you acknowledge that you understand and accept all terms listed below.

 

 

 

Service Overview

​

Sunshine Snap Photo Booth provides professional photo booth services as selected during the booking process, including rental equipment, attendants, digital delivery, printing when applicable, and custom design work. These Terms serve as a legally binding agreement between the Client and Sunshine Snap Photo Booth LLC and override any prior communication or representations.

Payments, Fees & Retainer

 

Retainer (Non-Refundable)

A 50% non-refundable retainer is required at booking to secure the event date. Your date is not reserved until both the retainer is paid and the booking agreement is executed. The retainer compensates the Provider for reserving the date and administrative preparation.

 

Final Balance

The remaining balance is due 15 days before the event. Failure to submit payment may result in cancellation without refund.

 

Additional Hours

Extra time requested at the event is billed at $150 per hour and must be paid prior to extending service.

 

 

 

Cancellation & Refund Policy

 

Client Cancellation 30+ Days Before Event

The retainer is non-refundable. Any other payments made are refunded in full within 14 business days.

 

Client Cancellation Within 30 Days of Event

All payments made, including the retainer, are non-refundable.

 

Failure to Pay

Missed payments are treated as a late cancellation and are non-refundable.

 

Provider Cancellation

If Sunshine Snap Photo Booth must cancel for reasons outside of Force Majeure, all payments including the retainer will be refunded. This is the Client’s sole remedy.

 

 

 

Service Operation & Performance

 

A trained booth attendant will be present for setup, operation, and breakdown unless the selected package specifies otherwise. If the booth cannot operate for at least 80% of the contracted time due to Provider fault, a partial refund will be issued based on downtime.

 

Clients must provide early venue access for setup and breakdown, a clear setup space (minimum 8 ft x 10 ft), and a dedicated 120V/20-amp outlet within 12 feet. Clients are also responsible for ensuring parking access and any required permits.

 

 

 

Outdoor Events & Weather Requirements

​

Outdoor events must provide continuous protection from sun, rain, wind, and uneven ground. If adequate coverage is not provided or environmental conditions threaten equipment, the Provider may refuse setup or suspend service. No refunds will be provided in these circumstances.

 

 

 

Internet Connectivity

​

A mobile hotspot is provided for real-time digital features, but performance depends on cellular reception. If internet is unavailable, the booth will operate offline and digital delivery will be completed once connectivity is restored. Refunds are not offered for connectivity limitations.

 

 

 

Conduct & Safety

​

Clients are responsible for maintaining a safe environment for both guests and equipment. Services may be suspended or ended immediately if the Provider encounters unsafe or abusive conditions, equipment threats, or hostile behavior. No refund will be issued if service ends for safety reasons.

 

 

 

Equipment Damage & Client Liability

​

Clients are responsible for any loss, damage, or theft of equipment caused by guests, vendors, or venue staff. The Client agrees to cover repair or replacement costs, potential loss of future income, and any related administrative or legal fees. This clause remains enforceable indefinitely.

 

 

 

Indemnification

​

Clients agree to indemnify and hold harmless Sunshine Snap Photo Booth LLC against any claims, damages, or expenses related to guest injuries, misuse of equipment, venue violations, or third-party claims connected to the event.

 

 

 

Force Majeure

​

Sunshine Snap Photo Booth is not liable for delays or failure to perform caused by events beyond its control, including natural disasters, venue closures, government restrictions, pandemics, or power outages. If services cannot be fully performed, the Client will receive a prorated refund for undelivered service time.

 

 

 

Rescheduling Policy

​

Clients may reschedule once without penalty if notice is provided at least 30 days before the event and the new date is within 6 months. Rescheduling is subject to availability. If rescheduling is due to a Force Majeure event, Sunshine Snap Photo Booth will attempt to accommodate a new date within 12 months.

 

 

 

Digital Delivery & Gallery Access

​

Digital galleries remain available for 2 years after the event date. After this time, galleries may be permanently deleted without notice. Sunshine Snap Photo Booth is not responsible for retrieving files after deletion.

 

 

 

Custom Design Policy

​

Clients must provide logos, templates, colors, and branding elements at least 25 days before the event. Packages include one initial custom design and one revision. Additional revisions are billed at $300 per hour. If a client does not approve final designs on time, a standard template may be used without refund.

 

 

 

Unlimited Print Sessions (If Applicable)

​

Unlimited print sessions apply to unlimited photo booth activations during the event, not unlimited duplicate prints. Guests receive one print per person per session. The Provider may restrict excessive or abusive printing behavior to ensure equipment longevity.

 

 

 

Model Release

​

By booking Sunshine Snap Photo Booth, the Client authorizes the Company to use photos, videos, and GIFs from the event for marketing, promotional, and portfolio purposes. The Client represents that they have the authority to grant this permission on behalf of all guests and agrees to indemnify the Provider for any claims related to image use.

 

 

 

Limitation of Liability

​

Sunshine Snap Photo Booth LLC is not liable for indirect, incidental, or consequential damages, including lost data, connectivity issues, venue limitations, or guest misuse. The Company’s maximum liability is limited to the total amount paid for services. This does not limit liability for gross negligence or intentional misconduct.

 

 

 

Governing Law & Dispute Resolution

​

These Terms are governed by the laws of the State of Florida. Disputes will first be addressed through informal negotiation, followed by non-binding mediation in Orange County, Florida. If unresolved, legal action must be filed in Orange County courts.

 

 

 

Privacy of Guest Data

​

Guest data collected through the photo booth is used solely for delivering content and communication related to the event. Sunshine Snap Photo Booth does not sell or share guest data except as required by law.

 

 

 

Insurance

 

Sunshine Snap Photo Booth LLC maintains general liability insurance. Clients are responsible for securing any additional venue-required insurance.

 

 

 

Entire Agreement

 

 

These Terms of Service constitute the complete agreement between the Client and Sunshine Snap Photo Booth LLC. They supersede all prior agreements, emails, or communications regarding the services provided.
